A family is demanding action after a 7-year-old died in a DUI crash involving an immigrant who was arrested earlier.

A Texas family is fighting for justice after a seven-year-old girl was allegedly killed by an illegal immigrant in a drunk-driving crash earlier this month.

Joel Gonzalez Chacin, 41, has been charged with intoxication manslaughter in the death of Ivory Smith, a second-grader at Klenk Elementary School in Houston.

“We have a lot of memories of Ivory,” Collins told “Fox & Friends” host Steve Doocy.

“He was a superstar to us. He loved to shine. He loved to dance. He loved to work out. He has a YouTube channel, and we’ll just miss him. He always had a smile, you see. He always had a smile, and the laws of Texas didn’t protect him.

Authorities confirmed to Fox News Digital that the 41-year-old migrant was drunk there. T-boned Christina Smith with her daughter Ivory at 2:45 a.m. on December 1.

Police say Chacin took pictures of the scene “in lieu of helping” and then drove away. Two victims it was a few minutes away from home.

“Unfortunately, he didn’t care. He didn’t care that it was a mother and daughter in that car,” Collins said. “He was injured, he didn’t try to help. He didn’t try to call for help. He got out. He took pictures, he tried to run away from the scene.”

Fox 26 Houston reported that court records showed that Chacin was placed in another ICE arrest earlier this year after being arrested for assaulting a family member in June.

The aggravated assault charge against him was eventually dropped and, after pleading guilty, Chacin was sentenced to 113 days in jail, which he had already served, and was released on the same day. The ICE detainer against him was also lifted the same day for an unknown reason.

“We want the laws in Texas to be strong,” Collins said. “If they decide to drink and drive, they decide to go to jail for a long time because they don’t give us that decision when we’re riding on the road trying to get home.”

“I should be able to ride. The people of Texas should be able to get in their cars and get home safe if we do everything right,” he continued. “We don’t have to worry about someone drinking and driving on the roads.”

According to a statement issued by the family, the mother, who has since been released from hospital, continues to suffer “physical and emotional trauma” from the accident.

“My niece lost her only child. Her father lost his only daughter,” Collins said. “Our family has lost Ivory, who was loved by our entire family. He was one of the youngest in the family, and we just want justice.”

“We are trying to get these laws changed because they are unfair. As you said, there are 12 days left before Christmas and we are planning a funeral instead of trying to celebrate Christmas,” he continued.
